Future Judges Must Acquire Three Years of Legal Experience Before Taking the Bench

Supreme Court Reinstates Experience Requirement for Lower Court Judges to Enhance Judicial Integrity

In a significant ruling that aims to elevate the standards of justice in India, the Supreme Court has reinstated a crucial requirement mandating lower court judges to possess a minimum of three years of experience as practicing lawyers or in judicial management. This decision, led by Chief Justice D.Y.Chandrachud and a three-judge bench, highlights the necessity of practical courtroom experience,a standard that had been in place until 2002. The ruling reflects a strong commitment to strengthening the integrity and effectiveness of the judiciary.

The decision arose from concerns raised during a 2022 case, which revealed that many lower court magistrates lacked the essential practical experience for sound judicial decision-making. Critics pointed out that without a solid understanding of courtroom procedures, newly appointed judges frequently enough faced challenges in delivering consistent and informed rulings. By reinstating the three-year experience requirement, the Supreme Court aims to equip future magistrates with the critical insights needed to navigate the complexities of the judicial system. This initiative goes beyond mere qualifications; it is indeed a strategic move to restore public confidence in the judiciary and underscore the vital role that experience plays in the pursuit of justice. As India continues to progress, ensuring a competent and credible judicial system remains paramount for the nation’s future.
